Our aim is to entice Warne to make himself available for selection, to be selected, and to play in one or more of the matches in the 2010/2011 Ashes Test Series v England. We hope to entice Warne by offering him a financial incentive. That financial incentive will be the sum of the contributions made through this web site in accordance with the terms and conditions set out below.
We are not a charity, nor are any contributions received to be used for charitable or community purposes. Contributions are not tax deductible. We are not a Deductible Gift Recipient (DGR). We are not operating a business. We will not make any profits. This is not an investment opportunity and this arrangement will not provide contributors with any financial benefit or other benefit consisting of rights or interests in property. If you make a contribution then you will not acquire any right to benefits because of your contribution to this arrangement (whether those rights are actual, prospective or contingent).
Term and Conditions1. Each contribution (less applicable merchant fees) will be deposited into a bank account specifically maintained for the purpose of this exercise. This is not an investment opportunity and this arrangement will not provide contributors with any financial benefit or other benefit consisting of rights or interests in property. If you make a contribution then you will not acquire any right to benefits because of your contribution to this arrangement (whether those rights are actual, prospective or contingent). We are not a charity, nor are any contributions received to be used for charitable or community purposes. Contributions are not tax deductible. We are not a Deductible Gift Recipient (DGR). We are not operating a business. We will not make any profits.
2. The cut-off date for contributions will be no later than 30 December 2010.
3. On or before 31 December 2010 we will make an approach to Warne offering him the sum of the contributions made through this web site.
4. If Warne accepts our offer, that is, agrees to make himself available for selection, is selected and actually plays in at least one match in the 2010/2011 Ashes Test Series v England:
a. Warne will be paid the sum of the contributions made through this web site (less any applicable government taxes and merchant fees). We have no control over how Warne uses the money should he accept our offer.
b. No contributions will be refunded.
5. If Warne agrees to make himself available for selection, is selected and actually plays in at least one match in the 2010/2011 Ashes Test Series v England but does so before our offer is made or in our opinion (acting reasonably), in substantial or complete isolation from our offer:
a. All contributions will be refunded by 31 January 2011.
b. Warne will receive nothing from us.
6. If Warne declines our offer, or for any reason does not play in at least one match in the 2010/2011 Ashes Test Series v England:
a. All contributions will be refunded by 31 January 2011.
b. Warne will receive nothing from us.
7. The result of the matches in the 2010/2011 Ashes Test Series v England are of no significance to this offer and we will not be held responsible for the result of any match.
8. Warne will be deemed to have played in a match if he is selected but is injured during the match and can take no further part.
9. Warne will not be deemed to have played in a match if he is selected:
a. but injures himself before a match.
b. as 12th Man for a match.
c. for a match that is not played due to rain.
10. In the event of any unforeseen circumstances (that is, circumstances not covered by these terms and conditions), we reserve the right to make any and all necessary decisions in our absolute discretion but to do so in the spirit of the exercise.
11. We reserve the right to alter these terms and conditions at any time in our absolute discretion, but will do so in the spirit of the exercise.
